100  Definitions - "Shipment"

    The rates and charges named herein apply only when a quantity of freight is tendered for transportation by one shipper, at one point, in one day, on one bill of lading or written shipping order, for one delivery to one consignee at one destination.

300  Determination of Mileage or Distance

    Except as otherwise provided herein, where rates are based on mileage, mileage or distance shall be determined by using the Prophesy Mileage and Routing Series Software.

400  Application of Rates

    This tariff will apply on the transportation of shipments of those commodities as authorized in Item 200, herein, at the following transportation rates per CWT:

SPECIAL NOTATIONS AND APPLICATIONS:

                  1.      All rates and/or charges found within this tariff are based upon the carrier supplying:
                           a)      One driver and vehicle with the proper and /or necessary tools and/or equipment
                                     to safely secure the shipment tendered so that it may be safely transported.
                          
b)      Cargo insurance coverage for the goods tendered at the carrier's released valuation
                                     limit as set forth in the item titled "Released Valuation" and found within this tariff.

                  2.      All rates and/or charges found within this tariff are based upon the shipper supplying:
                          
a)      All necessary means to load the carrier's vehicle with any shipments tendered,
                                    usually known as "Shipper's Load."
                          
b)      That the shipper load the carrier's vehicle and allow it to depart within two hours
                                    of the time set by the shipper for the carrier to arrive for loading.

                 3.      All rates and/or charges found within this tariff are based upon the consignee supplying:
                          
a)      All necessary means to unload the carrier's vehicle of any shipments consigned to
                                    him, usually known as "Consignee Unload."
                          
b)      That the consignee  unload the carrier's vehicle and allow i to depart within two
                                     hours of the time set by the consignee for the carrier to arrive for unloading.

                  4.      All rates and/or changes found within this tariff are based upon:
                          
a)      Shipment's tendered being legal in all transport dimensions. (See Section Note A)
                          
b)      That all shipments are tendered for transport at the carrier's released valuation limit
                                    as set forth in the item titles "Released Valuation" and found within this tariff.

WEIGHT PER LINEAL FOOT

                  1.  Rates shall apply on a per truck used basis.  To determine the applicable minimum weight per lineal foot, the provisions herein will be subject to a weight of 500 pounds per lineal foot (see exceptions 1 and 2) but not less than the minimum weight specified or the actual weight of the shipment, whichever is greater than the applicable rates.
                  2.  In computing the minimum weight applicable to a shipment, a maximum of 45 feet of lineal trailer space per trailer will be used.
                  3.  Any fraction of a foot will be considered a full foot.

         Exception 1:  Shipments which require in excess of 32 feet of the lengthwise loading space of a Standard Semi-Trailer (See Item Note 1) shall be considered as loaded to the capacity of the trailer.
        
Exception 2:  Shipments which require in excess of 22 feet of the lengthwise loading space of a Single Drop Trailer (See Item Note 2) shall be considered as loaded to the capacity of the trailer.

         Note 1:  The term "Standard Semi-Trailer" as used in this item refers to a semi-trailer having a flat deck not less than 36 feet in length.
        
Note 2:  The term "Single Drop Trailer" as used in this item refers to a semi-trailer having two loading levels. the lower of which is in excess of 39" from the ground or street level.

OVER WEIGHT / OVER SIZE PERMITS

   All over weight, over size, and over dimension shipments which require permits in order to meet regulations required for legal transportation will incur an additional charge for permitting.  Actual cost and expense to carrier will be charged plus a 20% administrative fee.  (See Section Note A)

SPACE RESERVATIONS

   Shipper/Carrier may elect, at their option, to reserve space reservation of a vehicle in increments of 1 foot lineal units of trailer floor space.  Each 1 foot will develop or constitute a weight of 1,000 pounds of reserved or purchased trailer floor space utilized or requested by shipper.  Carrier's Bill of Lading will be annotated as follows:
                 
"Space reservation of _______ lineal feet ordered by shipper.
                 
Shipment will move at a total weight of________ lbs, based on 1,000 lbs per lineal foot."

DETENTION TIME / WAITING TIME

   Detention Time, and delays encountered or resulting beyond carrier control, will be charged as follows:  Movements from origin to destination under 300 miles, first hour will be free.  Thereafter, $50.00 per hour will be charged, not to exceed an 8 hour period in any 24 hour period.

SPECIALIZED TRUCKS, TRACTORS, AND TRAILERS

         Additional charge will be made for the required use, or by request of shipper,
         of specialized trucks, tractors, and trailers as outlined below.

OVER DIMENSIONAL / OVERWEIGHT SHIPMENTS

   In addition to all other charges, an additional charge will be made to the core tariff charge for over dimensional/overweight shipments, as follows:

                  DEFINITIONS:

                  1.  "Over dimensional" is used herein to mean any item or shipment , after being loaded onto carrier's equipment, that requires Federal, State, County, or Local permits for legal movement of the shipment.
                 
2.  "Overweight" is used herein to mean any item or shipment which, after being loaded onto carrier's equipment, exceeds Federal or State bridge laws, or requires special permits for legal movement of the shipment.

Item Note 1:  Any dimension or weight over these paragraphs (a) and (b) will need to be rated and charged on an item-by-item or shipment-by-shipment Special Quotation.

EXPEDITED SHIPMENTS

                  DEFINITION:
                 
"Expedited Shipment" is used herein to mean any shipment that, due to shipper request, is dependent on a specific delivery date or time, or which is designated with a specific date which does not allow for reasonable dispatch.  In any case, due to factors that are not under our control (inclement weather, hours of service, scales, etc.) J.A. Miara Transportation, Inc. cannot guarantee delivery at any specific time.

SECOND DRIVER CHARGE

                  Rates in this tariff assume a single driver is utilized per vehicle per shipment.  When an additional driver is requested by the shipper and supplied by the carrier (a service commonly known as "Double Team Operation") an additional charge is applied.

CHARGES FOR EXTRA DELIVERY OR EXTRA PICK UP

                  1.  In the event of extra deliveries or extra pick ups en route to final destination, as directed by shipper and/or consignee, the additional charge per stop will be applied for each stop after original pick up and prior to final delivery to the furthest point traveled.

Section Notes A and B

         Note A:   When in order to comply with state or municipal laws, a shipment moving under the provisions of this item or tariff requires the furnishing of a flag car or pole car to accompany the shipment, carrier will furnish such a car at an additional charge of $1.50 per mile per car and driver, with a 100 mile per day minimum, with a $50.00 per overnight charge.
        
Note B:   For work performed on a Saturday, Sunday, Or Holiday, there will be a minimum charge of 8 hours.

500  Declared Valuations and Transit Insurance

Rates and charges so itemized in this tariff are based on the lowest declared or released valuations as follows:

         A.     PRESUMED RELEASE VALUATION

                  When a shipment is tendered to and accepted by the carrier for transport, and there is no reference made on the shipper's Bill of Lading as to the value of the goods or equipment tendered, then the shipment will be presumed to have been tendered to the carrier at the carrier's released valuation rate, and the extent of the carrier's liability for cargo insurance coverage will be to the maximum limit of it's declared released valuation limit as shown below and no higher.

         B.      CARRIER'S DECLARED RELEASED VALUATION

                  1.  Unless a greater value is declared by the shipper or his designated agent, at the time of pick up, the shipper will automatically release the value of shipment to Five Thousand Dollars ($5,000.00) for each Ton (2,000 pounds).  (See Section Note A)
                 
4.  When a number of distribution packages have been utilized, strapped, or otherwise fastened together, or contained on pallets, platforms, or skids, or have been over packed in an additional complying package, the carrier's maximum liability will be determined by separately multiplying the released value times the weight of each individual distribution package lost or damaged and not on the basis of the weight of the total number of distribution packages unitized, strapped, on skids, or over packed in additional complying package.  Where a distribution package contains articles which have released value rates or ratings and articles which do not, the carrier's maximum liability is to be determined by multiplying the total weight of the distribution package by the released value.

         C.     SHIPPER'S DECLARATION OF GREATER VALUE

                  If a greater value or declaration of value is so requested on carrier's bill of  lading, an additional transit insurance charge will be added to final charges.  Transportation rates are predicated and based on the valuation of articles so declared and transported.  Lowest rates are possible in relationship to lowest risk factors based on valuations.

                  NOTES

                  A)        All shipments in transit with interstate identity, that are held at carrier's terminal, warehouse, in or out of carrier's equipment will be protected by standard released valuation or for excess valuation (if purchased) for a total period of 30 days.  After 30 days, the excess declaration may be continued at customers request, for additional premiums of $1.10 per $1,000.00 of valuation per month or any fraction thereof, while shipment is in carrier's care or supervision.

DEFINITIONS

    "Carrier" means a motor common carrier or freight forwarder subject to Part II or IV of the Interstate Commerce Act.

    "Expedited Shipment" means any shipment that, due to shipper request, is dependent on a specific delivery date or time, or which is designated with a specific date which does not allow for reasonable dispatch.

    "Over dimensional" means any item or shipment, after being loaded onto carrier's equipment, that requires Federal, State, County, or Local permits for legal movement of the shipment.

    "Overweight" means any item or shipment which, after being loaded onto carrier's equipment, exceeds Federal or State bridge laws, or requires special permits for legal movement of the shipment.

EXPLANATIONS

         CONSECUTIVE NUMBERS

                  Where consecutive numbers are represented in this tariff by the first and last numbers connected by the word "to" or by a hyphen, they will be understood to include both of the numbers shown.
                 
If the first number only bears a reference mark, such reference mark also applies to the last number shown and to all numbers between the first and last numbers.

         FRACTIONS -- DISPOSITION

                  In computing a rate based on a multiple or proportion of another rate, the following will govern in the disposition of fractions:
              
Fractions of less than ½  or .50 of a cent -- omit.
           
   Fractions of ½ of a cent or greater -- increase to the next whole number.
